Government Allocated Rs.500 crore for IPPB for the year 2017-18

New Delhi: The government has allocated Rs500 crore to India Post Payments Bank for the financial year 2017-18 as it gears up to set up 650 branches across country by September 2017.

The government has allocated Rs125 crore as “capital infusion into corporate entity for India Post Payments Bank” and Rs375 crore as “grant in aid to India Post Payments Bank (IPPB)”, as per Output-Outcome Framework for Schemes 2017-18 for the department of posts (DoP) released on Monday.

India Posts is the second entity to roll out payments bank—though on a pilot basis—in Raipur and Ranchi, after Airtel that has earmarked Rs3,000 crore as initial investment for pan-India operations with an interest rate of 7.25% on deposits. Besides, Airtel is offering free money transfer from Airtel to Airtel numbers within Airtel Bank, money transfer to any bank account in the country.

The IPPB will offer an interest rate of 4.5% on deposits up to Rs25,000; 5% on deposits of Rs25,000-50,000 and 5.5% on Rs50,000-1,00,000. The total paid up equity of the new bank IPPB is Rs 800 crore, of which the government has already infused Rs275 crore.

Payments banks can accept deposits up to Rs1 lakh per account from individuals and small businesses. The new model of banking allows mobile firms, super market chains and others to cater to banking requirements of individuals and small businesses. The allocation to IPPB is part of Rs1,034.13 crore earmarked for the department of posts. The second big chunk of the total allocation, Rs279.6 crore, has been allocated for providing IT hardware and software in identified rural areas for improved access to services and customer satisfaction, resulting in increase in customer transactions, traffic and revenue.

The DoP has been allocated Rs110.83 crore for establishing e-commerce, parcel booking, international business centres, Rs73.5 crore for estates management, Rs32 crore for mail operations and Rs17.7 crore for equipments and IT infrastructure in rural post offices. The government has allocated Rs3.8 crore for setting up 246 offices and 200 outlets for providing better access to communication and financial services.

RBI raised withdrawal limit from savings banks accounts to Rs 50,000 from Rs 24,000

The Reserve Bank of India (RBI) said on Wednesday it would remove the cash withdrawal limit from ATMs and savings accounts from March 13. 


 Cash withdrawal limit from savings bank accounts will be relaxed to Rs 50,000 from February 20 to March 13, after which it will be removed, RBI deputy governor R Gandhi said after the monetary policy meeting. 

Several limits on cash withdrawals from banks and ATMs were imposed after the government’s surprise move to demonetise Rs 500 and Rs 1000 on November 8, 2016. 

Earlier, on January 30, RBI had allowed withdrawal upto Rs 24,000 from savings accounts. This was preceded by the relaxation on January 16 when the limit was raised to Rs 10,000 per day from Rs 4,500. 

The government has been saying the amount of currency in circulation would remain lower that what it was before November 8 even after remonetisation is completed, a move aimed at encouraging people to go cashless and adopt digital payment methods.

Finance ministry warns employees of action for criticizing govt policies

NEW DELHI: The finance ministry has warned employees of disciplinary action if they criticize the government or its policies. 

The directive assumes significance as associations representing employees of Central Board of Excise and Customs (CBEC) are protesting against certain decisions taken by the GST Council led by finance minister Arun Jaitley on Goods and Services Tax. 

"Instructions have been issued in the past wherein it has been impressed upon all concerned to refrain from commenting adversely on the government and its policies," the ministry said in a recent order. 

It said failing to comply with its instructions "may lead to appropriate action (including disciplinary action)". 

The instructions cite service rules that bar any government servant from making any adverse criticism of any policy or action of the government.

"No government servant shall, in any radio broadcast, telecast through any electronic media or in any document published in his own name or anonymously, pseudonymously or in the name of any other person or in any communication to the press or in any public utterance, make any statement of fact or opinion which has the effect of an adverse criticism of any current or recent policy or action of the central government or state government," reads the service rules.

Certain members of Indian Revenue Service (Customs and Central Excise), All India Association of Central Excise Gazetted Executive Officers, All India Central Excise Inspectors' Association and All India Central Excise and Service Tax Ministerial Officers Association had recently participated in a symbolic protest to oppose some decisions taken by the GST Council.

When contacted, President of IRS (Customs and Central Excise) officers association, Anup Srivastava, said their members are not adversely commenting on the state's policies by any way.

Ref:- judgment of the Hon’ble C.A.T. Principal Bench, New Delhi delivered on 12.11.2016 in OAS No. 749/2015, 3540/2015 and 613/ 2015 and report of Kamlesh Chandra GDS committee in chapter 18 relating to severance amount, service discharge benefits scheme etc.

Your kind reference is invited to the judgment of the Hon’ble Central Administrative Tribunal Principal Bench New Delhi delivered on 17.11.2016 is OAS No. 749/2015; 3540/2015 and 613/2015 copy enclosed for ready reference in which the Hon’ble Tribunal has struck down Rule 6 of the GDS ( conduct & Engagement) Rules, 2011. The Hon’ble Tribunal has further observed as follows in para 18 of the judgement:

However, Rule 6 is in direct conflict with the judgments in Vinod Kumar Saxena (supra), P.K. Rajamma (supara), and Dattappa (supra) cases, as it debars Gramin Dak Sevaks from pension. The direct fall out of these judgments is that a Gramin Dak Sevak, who retires as a Gramin Dak Sevak and not absorbed in Group “D” should be entitled to get pension based on the period served as Gramin Dak Sevak. It cannot be at par with regular employees as the working hours are different. Since we cannot get into determination of the factual position of whether Gramin Dak Sevaks work for 5 hours or 8 hours or less, we would consider working hour of Gramin Dak Sevak as 5 hours as stipulated in Rule 3-A and, therefore, the period for which their service as Gramin Dak Sevak should be counted for the purpose of pension should be 5/8th of the period actually spent as Gramin Dak Sevaks, for those who retire as Gramin Dak Sevaks.

2. The Hon’ble Tribunal has ruled in para 20 of the said judgment as:

To summaries, we dispose of the O.As. with the following directions to the respondents:

(a) For all Gramin Dak Sevaks, who have been absorbed as regular Group ‘D’ staff, the period spent as Gramin Dak Sevak will be counded in toto for the purpose of pensionary benefits.

(b) Pension will be granted under the provisions of CCS (Pension) Rules, 1972 to all Gramin Dak Sevaks, who retire as Gramin Dak Sevak without absorption as regular Group ‘D’ staff, but the period to be counted for the purpuse of pension will be 5/8th of the period spent as Gramin Dak Sevak. Rule 6 will accordingly be amended.

(c) The Gramin Dak Sevaks (Conduct and Engagement) Rules, 2011 are held to be valid except Rule 6, as stated above.

1. Thus paras 18.48 from para 18.48.1 to 18.48.8 relating to “severance Amount” and para 18.49.9 to 18.48.14 stand in validated and the GDS employees are eligible for payment of pension under the provisions of CCS ( Pension) Rules 1972 by treating the period of service rendered by them as 5/8th to be treated at par with departmental employee.

2. Regarding the report in paras 18.48.15 to 18.48.19 relating to gratuity, the following modification are to be made :-

(1) The nomenclature should be “Death cum Retirement Gratuity (DCRG)”

(2) The maximum amount of gratuity should be Rs 12.5 lacks (5/8th of maximum) for departmental employees.

3. Regarding other portion of report we shall be giving our views shortly in a separate letter.

You are, therefore, requested kindly to take these legal matters into view while implementing the report of the GDS committee.

New Benefits announced for NPS Subscribers in Union Budget 2017-18

In a bid to provide further impetus to the National Pension System (NPS), the following provisions have been introduced in the Finance Bill 2017 laid down in the Parliament today. 

Tax-exemption to partial withdrawal from National Pension System (NPS) 

The existing provision of SECTION 10(12A)of the Income Tax Act, 1961 provides that payment from National Pension System (NPS) to a subscriber on closurer of his account or opting out shall be exempt up to 40% of total corpus at the time of withdrawal . The amount utilized for purchase of annuity is also tax exempt. At the time of normal exit, 40% of the total corpus is mandatorily required to be purchased for annuity. The subscriber has the option to use higher amount for purchase of annuity. 

In order to provide further relief to the subscriber of NPS, it has been proposed to insert a new clause (12B) in the section 10 of Income Tax Act, 1961 to provide exemption on partial withdrawal not exceeding 25% of the contribution made by an employee in accordance with the terms and conditions specified under Pension Fund Regulatory and Development Authority Act, 2013 and regulations made there under. 

This benefit will be effective on partial withdrawal made by the subscriber after 1st April 2017. 

Further, Contribution up to 20% of the Gross Income of the Self-employed individual (Individual other than salaried class) will be deductible from the taxable income under Section 80CCD (1) of the Income Tax Act, 1961, as against 10% earlier.

This is with a view to provide parity between a salaried employee and a self-employed.

This benefit will be available on contribution made by the self employed persons on or after 1st April 2017. 

This increased limit for tax benefit will help the self-employed individuals, to save taxes on higher contribution in NPS and thereby properly plan for their old age income security.

Additional tax deduction on investment upto Rs. 50000/- under SECTION 80CCD (1B) will continue to remain the same for all NPS subscribers whether salaried or self-employed.
