Sub: Four monthly Meeting on 27.04.2016

The subjects for the four monthly meeting on 27.04.2016 are furnished in duplicate in the enclosed list which may kindly be received.

New Subjects:

Implementation of (SDBS) service Discharge benefit Scheme for GDS.

Though this scheme was introduced some three years back, it is not implemented in true spirit in our circle. The authorities at various level are not taking proper course of action in the interest of GDS officials. This subject has been discussed by this union in the previous formal meetings and much has been assured for the implementation of the scheme early. But the position remain static even at this distant date and the GDS employees who are retiring in the mean time are unable to even smell the fruit during their life time. It is therefore requested to take necessary steps for the immediate implementation of the scheme properly, covering the retired GDS employees as well to come under this scheme for enjoying the benefits.

Immediate payment of RPLI incentive money to the GDS employees in the circle.

Through out the circle, the eligible RPLI incentive money due for the GDS employees has not been paid to them for the past 3 years or so, attributing reason that necessary funds have not been allotted at the disposal of authorities at all levels concerned. Such reports are being received even from the Regional Heads and this is causing concern to the GDS employees. Without paying the eligible entitlements to the GDS, merely harassing them to procure RPLI business is quite inhuman. Since non payment of the incentive continues for years long, it gives rise to suspicion that the GDS officials are cheated in the shadow of incentive. It is requested that all the pending claims of incentive be paid to the GDS very immediately without further delay as the GDS employees are boiling with frustration.

Revision of TRCA to GDS employees on the basis of current statistics collected.

Due to frequent changes took place in fixing periodicity for the revision of TRCA to the GDS employees, revised statistics were not collected annually after the year 2007. In all Divisions, the statistics were lastly collected in the year 2007 only and thereafter fresh statistics have not been collected so far. But TRCA has been revised arbitrarily on the basis of old statistics available in file by unjustly reducing the earlier TRCA even with retrospective effect causing huge recovery. This appears to have been taken place in almost all divisions of the circle. It is therefore requested to kindly stop such arbitrary reduction of TRCA and cause to collect latest statistics for fixing revised TRCA since all the GDS are having heavy work load in these days.

மத்திய அரசு ஊழியர்களுக்கு பஞ்சப்படி

 மத்திய அரசு ஊழியர்களுக்கு 01.01.2016 முதல் 6 சதவிகிதம் பஞ்சப்படி வழங்கிட மத்திய அமைச்சரவை ஒப்புதல் அளித்துள்ளது. இதுவரை பெற்று வந்த 119% பஞ்சப்படி இனிமேல் 125% மாக இருக்கும்.

Subject: Reiteration of the instructions on streamlining the procedure for verification of claims of candidates belonging to Scheduled Castes, Scheduled Tribes and Other Backward Classes for purpose of appointment to posts/services — regarding

Madam/Sir,

I am directed to refer to this Department’s letter no. 36022/1/2007—Estt. (Res.) dated 20.03.2007 addressed to Chief Secretaries of all States/UTs (copy enclosed) regarding streamlining of the process for verification of claims of candidates belonging to Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs). It was also requested to issue instructions to District Magistrates/District Collectors/ Deputy Commissioners to ensure at their own level the veracity of caste certificates so that unscrupulous non-SC/ST/OBC persons are prevented from securing jobs meant for SCs/STs/OBCs by producing false certificates.

2. Owing to difficulties faced by candidates belonging to these reserved communities in various states in securing employment due to delays in obtaining caste certificates, this Department, vide an Office Memorandum of even number dated 08.10.2015, has re-iterated the instructions on providing provisional appointment to such reserved category candidates who are unable to obtain an appropriate caste certificate in time. It has been reiterated therein that where a candidate belonging to a Scheduled Caste, Scheduled Tribe or Other Backward Class is unable to produce a certificate from any of the prescribed authorities, he/she may be appointed provisionally on the basis of whatever prima-facie proof he/she is able to produce in support of his/her claim, subject to his/her furnishing the prescribed certificate within a reasonable time. If there is genuine difficulty in his/her obtaining a certificate, the appointing authority should itself verify his/her claim through the District Magistrate concerned. A copy of the OM is enclosed for reference and perusal.

3. In order to ensure that the candidates belonging to reserved categories do not face unnecessary problems in obtaining caste certificates, it is requested that instructions issued to the concerned authorities in the light of the aforementioned letter dated 20.03.2007 may be reiterated for information/compliance of all concerned.

4. It is also advised that in order to discourage unscrupulous activities, State Governments/UTs may consider issue of appropriate instructions for initiating disciplinary proceedings against the errant officers who default in timely verification of caste certificates or who issue false certificates.

Suggestion/feedback to GDS Committee:

The present GDS Committee has been appointed in place of a committee under a Supreme Court or a High Court retired Judge. Hence I expect judicial approach. The legal of status of GDS is: servants of the state and holders of Civil Post though outside regular Civil Services but not outside. They are ‘Civil services’ Government employees under Art. 311 of the constitution and hence under Art. 309. The present conduct and Engagement rules should be struck down and GDS be made subject to all other Rules and regulations as was prevendent at the time of 1st Central Pay Commission. The GDS perform all duties at par with Departmental employees and hence their pay-scale should be proportionately of par with Departmental employees according the principle enunciated by Justice Talwar Committee. Since the GDS perform several businesses which were unheard of when the cap of maximum five hours on work was clamped. Now the work in majority of B.O’s is more than five hours and up to eight hours. The cap on maximum working hours should be removed to be fair to the GDS. The Gratuity is termed as ex-gratia. It should be gratuity in true sense of the term. The pay scale should not be termed as time related continuity allowance as it is not based on recommendation of the committee of the time but in the product of some fertile brain of bureaucracy. The increment should not be ad-hoc but at par with that for Departmental employees. Being holders of Civil Post and servants of the state the GDS cannot be discriminated against. Those GDS who were appointed as such before 01-01-2004 should be paid pension at par with other Central Civil Servants; and thereafter strictly under the provisions of NPS. By virtue of being Civil Servants they are entitled to all allowances at par with other departmental employees. They are entitled to MACP and HRA also. It should be granted. On being killed by extremists or extremists etc. While on duly, fair compensation as permissible to other civil servants should be ensured. The nomenclature should be ‘Rural postal employees’ as they serve the rural population and B.O’s should be termed as rural post office.

Suggestions/feedback to GDS Committee:

The Judgement of the Supreme Court in Rajamma’s case which is also known as Gokulnanda’s case makes it amply clear that the Gramin Dak Sevaks formerly known as ED Agents are holders of Civil Post having master and servant relation with the state-the state being the master. The interpretation of the Government that the Judgement of the Supreme Court is limited to protection under Article 311(2) of the constitution is wrong and misconstrued. The Supreme Court has said that though out of “regular civil” services” not out of civil services. This means that they are civil servants though out of “regular civil services”, probably on account of having shorter working hours. Being civil servants the Gramin Dak Sevaks are entitled to all benefits of a civil servant though proportionately. The previous ED committee which was headed by officers of the department retired or in-services were very much biased and prejudiced against the GDS employees or EDA’s and did not do justice. Only Justice Talwar Committee appreciated the issues judicially and made suitable recommendations all though. The recommendations did not receive judicial treatment at the hands of the bureaucracy which implemented the recommendations after thoroughly manipulating the same.

A CPC or a committee to study a problem should be judicial and not prejudiced by any previous notion. This GDS committee, I feel, will work and examine the issues with the same judicial approach as a judge would have.Being civil servants the GDS should be granted scales of pay, corresponding to the pay scale of the departmental employees. The retirement or terminal benifits should similarly be granted to them as a civil servant should get and no restriction should be applied. To be specific: Those who entered service before 01-01-2004 should be granted pension under the granted benefit scheme as the other civil servants and those who entered service thereafter should be subjected to the terms of National Pension Scheme in strictest terms. All allowances I do not want to mention separately for want of space should be granted to them. Leave of all kinds should be granted according to the provision of leave rules 1972 as amended from time to time and should be granted retrospectively with benefit of accumulation of unused leave. The present conduct rules GDS (Conduct & Engagement) Rules, 2011 should be scrapped and the GDS employees should be made subject to all CCS rules and provision as was prevalent before 1959 from 1935. The designation should be “Rural Postal employees and the GDS system should be termed as Rural Postal services P.O’s being termed as rural B.O’s or rural S.O’s.

கிளை அஞ்சலகத்திற்கான கையடக்க கருவி ( Rural ICT Hand Held Device )

Features of Rural ICT Handheld Device Supplied to Branch Post Offices


Following re the important features or benefits of Hand-held device supplied to Branch Post Offices.
1.  Electronic transactions- Booking and delivery of Speed Post, registered mail, money orders, sale of stamps and postal stationery will be done through these devices and paper receipt shall be generated

2.  Instantaneously thereby eliminating chances of overcharging and other problems associated with manual transactions. Savings Bank deposits & withdrawals, PLI/RPLI premium deposits and loan/claim payments will also be done electronically on these devices.

3.  Immediate uploading of transaction data and financial reconciliation- Using mobile connectivity, data pertaining to all transactions done on the hand-held devices shall be uploaded onto the central server. E-Money order will reach the destination post office instantaneously unlike present day where the money order is digitized at the nearest computerized Post Office and leads to delay in delivery. All financial transactions shall also be reconciled immediately without any manual intervention and Cash on Delivery amount collected in the village shall be immediately credited to the account of e-Commerce Company. Similarly the artisans would be able to fulfill e-commerce orders and receive immediate payment for their sold products online. This will have a positive impact on the overall economy of the villages.

4. Automatic track and trace- Speed Post and Registered letters/parcels and money remittances will be trackable at the Branch Post Office level and booking/delivery information will also be uploaded to central server immediately.

5. Fraud and leakage elimination- As Savings Bank and Postal Life Insurance transactions will be done on a real-time basis and through immediate generation of receipt and voice message, chances of fraud would be eliminated. Biometric authentication of MNREGS and social security beneficiaries at the time of pay-out would also reduce leakage in the schemes


6. Post Offices as Common Service Centres- Branch Post Offices shall be able to work as Common Service Centres and offer services such as Railway Reservation, online bill payment for electricity and water utilities, mobile and DTH recharge, insurance policy premium payments & transactions for partner banks/insurance companies/mutual funds etc
